These Terms of Service ("Terms") form a legally binding agreement between you and Vela Health ("Vela Health", "we", "our", or "us") governing your use of the Vela mobile application ("the app") and the velahealth.health website ("the Site"). By downloading, accessing, or using Vela, you agree to these Terms. If you don't agree, don't use Vela.
You must be at least 13 years old to use Vela. If you are under 18, you represent that you have your parent or guardian's permission. Vela is designed for adults navigating perimenopause or menopause.
Vela is a menopause companion that helps you track symptoms, find personal patterns, and prepare for doctor visits. The app stores your health data on your device and provides pattern analysis, Ask Vela observations based on your logged data, and doctor-ready reports. The Site is informational and collects waitlist signups.
All content in Vela, including pattern analysis, correlations, Ask Vela responses, daily briefs, anomaly observations, and doctor visit reports, is for informational and educational purposes only. It is not medical advice, diagnosis, or treatment.
Always consult a qualified healthcare provider for medical decisions. Never disregard professional medical advice or delay seeking it because of content in Vela. If you think you may have a medical emergency, call your doctor or emergency services immediately.
All health data you enter in the app is stored locally on your device. We do not have access to your symptom logs, mood entries, or notes. If you delete the app, your data is permanently lost.

If and when Vela's community features are enabled, posts and replies you submit are visible to other users. We reserve the right, but are not obligated, to review, moderate, edit, or remove any content that violates these Terms. We are not responsible for content posted by other users. Do not share personally identifying information about yourself or others in community posts.
All content, design, trademarks, logos, text, graphics, and code in Vela and on the Site are owned by Vela Health or our licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use Vela for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works without written permission.
Your on-device data belongs entirely to you. If you voluntarily post content in community features (when enabled), you grant Vela Health a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the Vela service. You can delete your posts at any time.
VELA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT HEALTH INSIGHTS, PATTERNS, OR EDUCATIONAL CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC SITUATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELA HEALTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY) ARISING FROM YOUR USE OF VELA, INCLUDING HEALTH DECISIONS MADE BASED ON APP CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Vela Health from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your violation of these Terms, your misuse of Vela, or content you post in community features.
We may suspend or terminate your access to Vela at any time for any reason, including violation of these Terms. You can stop using Vela at any time by deleting the app. Sections that by their nature should survive termination (including Sections 3, 8-12, and 14-17) will survive.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. If any dispute arises, you and Vela Health agree to first attempt to resolve it informally by contacting support@velahealth.health.
Any dispute not resolved informally will be resolved through binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, conducted in English. You waive the right to a jury trial and to participate in class actions, to the extent permitted by law. Small claims cases may proceed in court.
We may update these Terms from time to time. The "Effective date" above reflects the most recent change. For material changes, we will provide notice through the app or email (if you're on our waitlist). Continued use of Vela after changes constitutes acceptance.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Vela Health regarding Vela. Our failure to enforce any right is not a waiver of that right.
